This privacy policy describes what personal data you share with us and when and how and for what purposes we process your personal data. It also describes how we thereby comply with our legal obligations. We recommend that you read the Privacy Policy carefully and keep a copy of it for your own records. If you have any questions, you can of course always contact us.

1. CONTROLLER

Data controller for the processing of personal data is: Guidion Nederland B.V., based in Amsterdam. Registered in the Chamber of Commerce under number: KVK 34235335.

We believe it is important to handle the personal data that is entrusted to us in a transparent and responsible manner. We therefore process your personal data carefully and in accordance with the General Data Protection Regulation (“AVG”) and the associated relevant laws and regulations.

2. WHAT DATA DO WE PROCESS?

We process personal data from various people, for example visitors to our website, potential employees or experts (freelancers) who respond to an advertisement or experts (freelancers) who enter into an agreement with us.

2.1 Information about visitors to the website

a. IP addresses and click, search and surf behavior: To see how our Website is used, we keep track of visitors' clicking, searching and surfing behavior. For this purpose, we use: IP addresses, data from the browser or hardware used and information from cookies. You can read how, what and what we use which cookies for in our cookie notification. The IP addresses are processed anonymously only.

b. Contact details You can contact us via the website and leave your contact details. This includes the following information: name and address details, email address, telephone number and any other information that you enter yourself as the content of a message.

2.2 Data about potential employees and freelancers

As part of your application and recruitment and selection, we process the following (personal) data: name and address details, e-mail address, telephone number, Curriculum Vitae, motivation letter and any other information that you send with your application.

2.3 Prospective customer data

In the context of recruiting new customers, we process the following (personal) data: email address, name of person, position, company name and telephone number.

3. PURPOSE OF PROCESSING PERSONAL DATA

We use the personal data for the following legal bases and purposes:

3.1 Processing necessary for the protection of our legitimate interests

a. Anonymous statistical research We only use the anonymized (personal) data and information from article 2.1 (sub a) for aggregated and anonymous (online) research and analysis of the use of the website. Based on these studies, we can adapt and improve the website.

b. General contact We use the information in article 3.1 (sub b) to provide the information you have requested or to process your applications or other questions.

c. Recruitment and selection We process the data referred to in article 2.2 to carry out our recruitment and selection activities, including taking tests and assessments. A reference study and/or other surveys using the personal data may be part of the recruitment and selection. The data, information and results of tests, assessments and/or other studies can be used to determine what additional training and training is required for the applicant or expert. We can use third parties to process this data, including Recruitee B.V. and Equalture at the moment.

3.2 Processing in the context of the execution of the agreement

In the event that an agreement is concluded with the employee, the employment contract with the employee separately specifies how we deal with the privacy and personal data of the employees.

In the event that an agreement is concluded with the expert, the data referred to in article 2.2 will be processed in the context of the execution of the assignment agreement. The data is used, among other things, to contact you, send orders and invoices, etc. In addition, the data can be used, for example, to select you for certain customers/clients, for example based on educational level/quality.

3.3 Consent-based processing

Via the website, you can sign up for Guidion's newsletter, which reports new orders in the region. When you sign up for this, your name and email address are stored.

Via LinkedIn, we use Lead Gen Forms, which collect data from LinkedIn users. This takes place on the basis of permission given to LinkedIn when adjusting the settings, giving permission to share data with third parties.

3.4 Processing based on a legal obligation

We also process personal data in order to comply with our legal obligation, such as the administrative obligation of the tax authorities.

4. RETENTION PERIODS

We do not process your personal data longer than necessary for the purpose for which this data is being processed. Once we have dealt with your question or sent the information you requested, we will keep your personal data for a period of up to four weeks.

If you do not join Guidion after the end of the application process, we will not keep your data longer than 4 weeks after the end of the procedure. If we are unable to offer you a position, we can - with your consent - keep your application data for a maximum of one year after the end of the application process. If you are hired as an employee or expert, we will process your personal data under the employment contract or expert assignment agreement.

If we no longer need to keep the personal data for the reason mentioned above, we will destroy and/or anonymise the personal data unless (i) we are required by law (e.g. tax law) or (ii) to keep certain personal data longer. In which case, only the personal data that is specifically necessary for that purpose will be retained during the applicable retention period.

5. PROVISION OF PERSONAL DATA TO THIRD PARTIES

We will not share your personal data with other parties unless this is necessary in the context of the execution of the agreement, we have engaged them to process certain data, we have a legitimate interest in doing so, to comply with a legal obligation, or you give your consent. This includes the provision of personal data in the context of the operation and functionality of the website, analysis and improvement of our website, and other necessary processing.

Guidion has made agreements with all parties that have access to your personal data, so that there are sufficient guarantees for the careful processing of your personal data. This is in accordance with the law and the internal privacy policy. If we also provide third parties with access to your information, we will only do so if we are sure that those third parties only use the information in a way that and for a purpose that is related to the purpose for which we obtained it. And only in accordance with this privacy statement. In addition, we always look at how we can respect your right to privacy as much as possible.

6. SECURITY OF YOUR PERSONAL DATA

We take all reasonable, appropriate security measures to protect your information from unauthorized access or alteration, disclosure, or destruction. We store the personal data that we process in a secure database that is protected by technical access controls. In doing so, we comply with the applicable security standards. If we provide your personal data to other organizations and carry out assignments, we ensure that they also (must) protect the personal data optimally. Furthermore, the confidentiality obligations required by law always apply.

In order to provide our services, Guidion may provide your personal data to parties located outside the European Economic Area (EEA), for example because a data center or our supplier is located there. We only do this if there is an appropriate level of protection for the processing of personal data. This means, for example, that we use model agreements approved by the European Commission or make agreements about the handling of personal data.

7. YOUR RIGHTS

Under the GDPR, you have several rights:

  • Right to view: you have the right to view the personal data that we process about you.
  • Right to rectification: You have the right to correct or supplement the personal data that we process about you if it is inaccurate or incomplete.
  • Right to withdraw your consent: You can easily withdraw your consent at any time.
  • Right to object: you can object to the processing of your personal data.
  • Right to deletion: you can request that we delete your personal data.
  • Right to data portability: if it is technically possible, you have the right to have the personal data that we process about you transferred to a third party.
  • Right to restrict processing: In some cases, you may request that the processing of your personal data (temporarily or otherwise) be restricted, which means that we process less of your data.

If you want to make use of one of these rights, we may ask you to identify yourself. To do this, we request information to ensure that you are the right person to whom the personal data belongs. We do our best to always respond within four weeks of receiving a request, but reserve the right to extend this period by two months.
